2. Legal bases and principlesWe process personal data under the GDPR, the Austrian Data Protection Act (DSG) and, where information is stored on or read from your device, the Austrian Telecommunications Act 2021 (TKG 2021).
Depending on the processing activity, we rely in particular on Art. 6(1)(b) GDPR (handling inquiries, pre-contractual measures, contract performance), Art. 6(1)(c) GDPR (compliance with legal obligations), Art. 6(1)(f) GDPR (legitimate interest in a secure, functional website and in asserting legal claims), Art. 6(1)(a) GDPR (consent) and Section 165(3) TKG 2021 (storage of or access to information on your device).
3. Website access and server log dataWhen you access the website, technical data is exchanged between your device and our servers/delivery networks, including your IP address, date and time of access, the page or file accessed and the amount of data transferred, the referrer address, browser type and version, operating system, device characteristics and language settings, and status codes and technical error/security information.
This is necessary to deliver the website, ensure its stability and security, detect technical errors and prevent misuse (Art. 6(1)(f) GDPR).
We do not combine this data with other sources or use it to identify individual visitors. Log data is deleted or anonymised once it is no longer required for the purposes stated.
4. Website platform Tilda and internal traffic statisticsProvider: Tilda Platform Cloud Services Co. LLC, License No. 1110180, P.O. Box 452972, Dubai, United Arab Emirates (“Tilda”).
Purpose: providing, delivering, technically securing and maintaining the website, processing forms, and internal traffic statistics.
Data: the technical data described in Section 3 and, if you use a contact form, the form data described in Section 6.
Legal basis: Art. 6(1)(f) GDPR. Tilda’s internal statistics are currently configured without a statistics cookie and are not used for advertising purposes.
Sub-processors: according to Tilda’s current contractual documentation, Hetzner Online GmbH, G-Core Labs S.A. and Google Cloud EMEA Limited may act as sub-processors.
Third-country transfer: Tilda is based in the United Arab Emirates. Where personal data is transferred there or to other third countries via sub-processors, Tilda relies on the European Commission’s Standard Contractual Clauses (Art. 46(2)(c) GDPR) and supplementary safeguards; for recipients in the United States, an adequacy decision under Art. 45 GDPR may additionally apply where the recipient is certified accordingly.
5. Cookies, session storage and similar technologiesThe website is currently configured so that Tilda’s internal statistics do not set a statistics cookie.
Technically necessary functions may use your browser’s session storage; such information is generally deleted at the end of the browser session.
Storage of or access to information on your device that is strictly necessary for a function you explicitly requested takes place under Section 165(3) TKG 2021 without separate consent; any subsequent processing of personal data relies on Art. 6(1)(f) GDPR.
Non-essential cookies or comparable technologies are only used with your prior consent under Art. 6(1)(a) GDPR in conjunction with Section 165(3) TKG 2021.
Google Analytics, Meta Pixel and similar advertising or profiling tools are not currently integrated.
6. Contact formsData processed: name, e-mail address, phone number, the service selected or form/page context, time of submission, and technically required metadata.
Purpose and legal basis: we use this information to allocate and respond to your inquiry. Where an offer, a possible engagement or an existing contract is concerned, Art. 6(1)(b) GDPR applies; for general business inquiries we rely on Art. 6(1)(f) GDPR.
Tilda Leads: form submissions are stored in Tilda’s “Leads” area and deleted there after 30 days; they may be forwarded to our Microsoft 365 / Outlook mailbox for further processing.
Fields marked as mandatory are required to process your inquiry; other fields are voluntary.
Please do not submit health data, medical records, ID copies, criminal information or other particularly sensitive data via the general contact form.
7. Communication via Microsoft 365 / OutlookProvider: Microsoft Ireland Operations Limited, Dublin, Ireland.
Our mailbox
office@agtinpro.com runs on Microsoft 365 / Outlook. We process sender/recipient data, subject, message text, attachments, timestamps and technical transmission information on the basis of Art. 6(1)(b) and (f) GDPR, and Art. 6(1)(c) GDPR where retention obligations apply.
Microsoft processes data as a processor and may process data outside the EEA in the course of support, security and sub-processing, relying on adequacy decisions under Art. 45 GDPR and the Standard Contractual Clauses under Art. 46(2)(c) GDPR.
8. Google FontsThe website currently loads Google Fonts via Google’s interface for consistent typography. Your browser establishes a direct connection to Google, which receives your IP address, the requested address, technical browser/device information and, where applicable, the referrer address.
According to Google, this data is not used to build end-user profiles or for personalised advertising.
Provider: Google Ireland Limited, Dublin, Ireland; processing by Google LLC, USA, cannot be ruled out.
Legal basis: Art. 6(1)(f) GDPR.
9. Occasional forwarding to agtinpro TOV in UkraineA website inquiry is not routinely forwarded to agtinpro TOV, a Ukrainian limited liability company.
Forwarding only takes place on a case-by-case basis, where appropriate for your specific matter and after you have given separate and explicit consent following prior information.
Possible recipient: agtinpro TOV, Kapushanska Street 110, Office 224, Uzhhorod, Zakarpattia Oblast, Ukraine.
Legal basis: Art. 6(1)(a) GDPR and, in the absence of an adequacy decision for Ukraine, Art. 49(1)(a) GDPR; this exception is used only for occasional, non-repetitive transfers.
Ukraine may not offer a level of data protection equivalent to the EU, particularly regarding government access, enforcement and data subject rights; you will be informed of these risks before giving separate consent.
You may withdraw consent at any time with future effect by e-mail to
office@agtinpro.com; this does not affect the lawfulness of processing carried out before withdrawal.
10. Retention periodWe retain personal data only as long as necessary for the relevant purpose, or as long as statutory retention obligations or legitimate interests in pursuing legal claims exist.
In particular: Tilda Leads form data — 30 days from receipt; business e-mail correspondence without a resulting contract — generally up to three years after the last relevant contact; contract-, accounting- or tax-relevant documents — generally seven years under Section 212 of the Austrian Commercial Code and Section 132 of the Federal Fiscal Code; consent records — for the duration of the processing based on them and thereafter as needed to defend against claims; technical log data — per the criteria in Section 3.
11. Recipients and processorsAccess within agtinpro GmbH is limited to staff who need the data for the purposes stated.
Data may also be shared, to the extent necessary, with: Tilda and its sub-processors; Microsoft and its sub-processors; Google in connection with Google Fonts; agtinpro TOV in Ukraine only as described in Section 9; and tax advisors, auditors, legal counsel, banks, insurers, courts, administrative authorities and other public bodies where legally required or necessary to pursue legal claims.
12. Your rightsSubject to the statutory requirements, you have in particular the right to access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), objection to processing based on legitimate interests (Art. 21), and withdrawal of consent at any time with future effect (Art. 7(3)).
